Mayor and Council to Discuss Unsafe Streets in Rockville

At Monday’s Council meeting, Rockville’s Environment Commission will present its annual report of accomplishments and outline its plans for the future.

At its Monday, January 22, 2024 meeting, the Rockville Mayor and Council will discuss police pension. On the Consent Calendar (items approved without discussion) are contracts for equipment or services related to building construction and repair ($140K); security enhancements to the water treatment plant ($136K), equipment and support for the Data Center ($1.9M); and playground maintenance and repair ($850K), among others. The Mayor and Council will also receive reports on Bus Rapid Transit on MD 355; Environment Commission; Vision Zero; Bikeway and Pedestrian Master Plan; Procurement; and the outreach program for minority, female, disabled, and veteran-owned businesses. 

The Montgomery County Department of Transportation has been considering Bus Rapid Transit (BRT) throughout the county, including Viers Mill Road (MD 586) and the Rockville Pike (MD 355) in Rockville, to provide fast and reliable public transportation using dedicated lanes on the busiest streets (Agenda page 5+). In July 2019, the County Council stated they preferred two dedicated lanes in the median (one lane in each direction in the center of the street) for MD 355, however, design has become more complicated for the area near College Parkway. Furthermore, the project will affect Rockville’s Vision Zero, Bikeway, and Rockville Pike plans. To help pay for the project, the County has requested a $1 million contribution from Rockville’s portion of the Montgomery County Transportation Impact Tax. 

On Monday, the Council will receive an annual report on Vision Zero, including there were three (3) fatal and twelve (12) serious injury crashes in Rockville in 2023. Of those three fatalities, two were pedestrians and one was a motorist. Injuries to pedestrians has returned to pre-pandemic levels.

In July 2020, the Mayor and Council adopted the Vision Zero Action Plan (page 28+). Vision Zero is a multidisciplinary traffic safety program with the overarching goal to wholly eliminate deaths and serious injuries that result from traffic crashes. This program is designed for all roadway users: motorists, pedestrians, bicyclists, and transit users. This program departs from past roadway safety programs by explicitly rejecting any traffic death or serious injury as acceptable and recognizing that people will often make mistakes while traveling, but mistakes should not result in death or serious injury. A recent study revealed six roads in Rockville as “High Injury Network” segments, which means there have been at least four fatal or serious injuries crashes: Rockville Pike (from Veirs Mill Road to Bouic Avenue); West Montgomery Avenue (from Research Blved to Mannakee Street); Norbeck Road (from First Street to Avery Road); Frederick Road (from Ridgemont Ave to Watkins Pond Blvd); Veirs Mill Road (from Rockville Pike to Twinbrook Parkway); and North Washington Street (from Hungerford to W. Jefferson St.). Unfortunately, most of these highways are controlled by the State of Maryland (N. Washington Street is the only City-maintained roadway among those listed). Time to contact your State Senator and Delegates to light a fire under the State Highway Administration!

Meanwhile, in the State of Maryland

The 90-day legislative session has begun! Taxes and cost shifts are on the table for the General Assembly session as Gov. Wes Moore (D) and lawmakers look to solve both a structural budget shortfall and massive cuts to transportation projects. In November, legislative budget analysts told the joint Spending Affordability Committee that the state faces a structural gap of $322 million in the coming legislative session. Projections show the gap continuing to grow in fiscal 2026 and 2027 to $376 million and $436 million respectively. More at MarylandMatters.org.

State Delegate Joe Vogel (District 17) is among the seven state lawmakers who are currently running for Congress in either the 3rd or 6th districts, with the primaries fast approaching on May 14.

The FBI arrested Carlos Ayala of Salisbury, a State Board of Elections member, for participating in the January 6 insurrection. He resigned from the Board of Elections on January 11. Ayala was appointed to the state Board of Elections last year by Gov. Wes Moore (D) following a recommendation by the Maryland Republican Party. Looks like they need to do a deeper background check before appointing people to public office. 

Rockville Mayor and Council Set to Approve Tower Oaks Development in Final Meeting for Newton and Feinberg

At its Monday, October 30, 2023 meeting, the Rockville Mayor and Council will approve the Tower Oaks townhouse development, possibly adopt the pedestrian master plan, and discuss the City’s personnel manual and County’s development impact tax. On the Consent Calendar (items approved without discussion) are right-of-way agreements for Joseph Street, reclassifying a private road to a public street with waivers for the Tower Oaks townhouse development, contracts to perform stormwater cleanouts, asphalt-concrete improvements to city parks, for the Linkages-to-Learning program and Senior Nutrition Program, among others. The Mayor and Council will also receive reports on the police department deployment plan (which includes the most recent crime report for Rockville, see figure 1). Strangely, the recent issues with the election are not on the agenda (but I suspect they will be mentioned in Community Forum).

This will be the last Mayor and Council meeting attended by Mayor Bridget Newton and Councilmember Beryl Feinberg because they are not seeking re-election; a reception in their honor will be held at 5:00 pm.

Candidates Share Their Vision for Rockville at October 5, 2023 Forum

Community Reach of Montgomery County, in partnership with Rainbow Place Shelter, hosted a Rockville Election 2023 Candidate Forum at the F. Scott Fitzgerald Theatre on October 5, 2023. The Forum, which was a significant event in the lead-up to the November election, saw candidates take to the stage to present their qualifications, experiences, and key policy positions. It’s important to note that the candidates’ statements were not independently verified, or as Ronald Reagan loved to say, “trust but verify.”

Candidate forums are a valuable opportunity for voters to hear directly from the candidates on a range of important issues but if you didn’t attend or don’t have time to watch the 90-minute replay on YouTube, I’m offering ChatGPT-generated summaries (with some light editing) to the candidates’ responses to the major questions in the attached six-page handout (thanks TM!). This will enable you to swiftly share your preferred candidate’s stance on issues with friends and family, strategize on the optimal choices for Mayor and Council seats, or potentially identify which candidates may be unclear, evasive, or inconsistent in their responses.

If you’re a candidate, these summaries could serve as a tool for reviewing your positions and assessing how effectively you stand out from others. Do the summaries accurately capture your ideas? Did any crucial points get overlooked? How do your views align or differ from other candidates? Are your statements well-rounded, or do they lean towards being too abstract or too specific? Do any of your opponents exhibit a significant lack in knowledge or critical thinking?

Clouded Judgment? Mayor and Council to Discuss Vape Shop Regulations

At its Monday, July 31, 2023 meeting, the Rockville Mayor and Council will discuss a park impact fee for new residential developments, taxes for FY2024, amending the responsibilities of the Cultural Arts Commission, and extending the moratorium on vape shops. On the Consent Calendar (items approved without discussion) are contracts for improvements to the King Farm Farmstead. This regular meeting will be preceded by a Closed Session to discuss the retention of a business (in an unusual move, the public may join the audio conference by phone).

In March 2023, the Mayor and Council adopted a nine-month moratorium on vape shops (businesses that dedicate more than 25% of its floor area to the sale, display, or use of electronic cigarettes; business with less than 25% of floor space dedicated to e-cigarettes are not affected). This moratorium expires on December 27, 2023, so the City is considering whether to adopt new regulations for vape shops or extend the moratorium. There seem to be ten vape and/or tobacco shops located in the city limits, primarily along Hungerford Drive and Rockville Pike (MD 355) along with numerous convenience stores (such as 7-Eleven), grocery stores and other retailers that sell cigarettes and electronic smoking products. Interestingly, the federal government adopted legislation in December 20, 2019 that increased the minimum age of the sale of tobacco products from 18 to 21 years old (somehow at 18 you have enough intelligence to vote, get married, or join the army but not enough smarts to buy a cigarette).

It’s unclear why the moratorium was implemented or what the Council is attempting to control, but if it’s to keep children from smoking, this may be the wrong solution. The staff report reveals that, “most underage vape/e-cigarette users do not purchase vapes from vape shops…Numerous studies show that the majority of underage users purchase or borrow vape pens from friends, purchase them online, or purchase them from convenience stores or grocery stores where age verification may be more lax.” Are e-cigarettes worse for your health than cigarettes, thus require additional regulation? Are national laws so insufficient that Rockville needs its own unique response? Somehow, this reminds me of Footloose. More details starting on page 141.

The Mayor and Council is considering revised responsibilities for the Cultural Arts Commission with troubling consequences for citizen involvement. This change is happening at the behest of the Cultural Arts Commission to promote “inclusivity and cultural richness” but they may not have noticed that the revised responsibilities also disempowers them. As proposed, the Commission will no longer review the budget for the Civic Center (where performing and visual arts are primarily presented in Rockville) nor review the design of all new City-owned cultural facilities. Instead, their primary responsibilities are to advise and make recommendations to the Mayor and Council, not encourage, assist, foster, or work. How often will the Mayor and Council ask for their advice or recommendations? The Commission is becoming more passive, less active. More details starting on page 135.

Mayor and Council to Review Policies for Managing Grants, Staff, and Sponsorships

At its Monday, May 22, 2023 meeting, the Rockville Mayor and Council will receive reports on the city’s management of its grants, staff vacancies and hiring (p. 186), recreation and parks sponsorship policy (193), and proposed personnel policies and procedures (197). On the Consent Calendar (items approved without discussion) are grant agreements for Rockville Senior Center, Twinbrook Community Recreation Center, F. Scott Fitzgerald Theatre, and the Rockcrest Ballet Center. The Mayor and Council will also issue five proclamations, including the recognition of Eritrean Independence Day on May 24 (do you know where Eritrea is located?).

Eleventh House Solutions is recommending that the City adopt a policy to bring consistency and control over grant activities. Currently, grant management is “decentralized throughout the City and are nonexistent in several departments that could benefit from grant funding. This has made grant information difficult to retrieve or track in some departments.” Furthermore, “except for Public Works, no grants or funding program had a system to track the grant’s requirements or conditions. Without these documents, departments risk not complying with grant conditions which could result in the rejection of reimbursement requests or loss of grant funding.” Kudos to the Public Works Department, who were also called out as a “perfect example of how a grants process, although informal, implemented from the top down can expand programming and, therefore, further the City’s mission and priorities.” For more details, see the consultant’s report of findings and recommendations starting on page 33 and departmental comments starting on page 43. One interesting finding is that the City Council’s approval process and August recess can delay agreements by two months (49)—is it time for them to meet year ’round?

According to the Staff Vacancy and Hiring Report (187), two positions are frozen (Human Resources Associate and Principal Network and Cyber Security Automation Engineer) and four on hold pending release (Senior Planner, Information Systems and Cyber Security Engineer, Secretary, Recreation Facilities Clerk, and Maintenance Worker III).

Mayor and Council Tweaking FY2024 Budget

At its Monday, May 1, 2023 meeting, the Rockville Mayor and Council will discuss the FY2024 Budget (that’s it!). On the Consent Calendar (items approved without discussion) are four proclamations for Asian American and Pacific Islander Heritage Month, Historic Preservation Month, Older Americans Month, and National Public Service Recognition Week.

The City Council is continuing to adjust the budget. Reductions include the Movies in the Park series, residential street sweeping, composting, Latino Youth Development Program, Lincoln Park Community Center, Thomas Farm Community Center After School programs, Twinbrook rentals, and Peerless Rockville [just in time for Historic Preservation Month!] (page 18). Increases include fall protection at the Senior Center, mowing for cross country events at RedGate, Teens on the Go program, energy audits, badge system annual fees, and overtime pay for Rockville Police (page 18). Concerned? Community Forum happens at 7:10 pm (but you have to request to speak by noon of the day of the meeting at mayorandcouncil@rockvillemd.gov; no more opportunities to just drop in!).

Mayor and Council to Approve Isolated Neighborhood on Tower Oaks Blvd.

At its Monday, April 24, 2023 meeting, the Rockville Mayor and Council will discuss an amendment for a permit to construct 83 townhouses in Tower Oaks and a work session on the 2024 budget. On the Consent Calendar (items approved without discussion) are the installation of solar canopies on two city parking lots, an agreement with the Rockville Baseball Association, contracts to repair pedestrian bridges in city parks, and installation of murals at the Senior Center (artist Katie Giganti) and on the City Hall generator screen (artist Shawn James), among others.

The City of Rockville will be installing “Connections,” a mural by artist Katie Giganti for the rear exterior wall of the Senior Center.

Another isolated neighborhood is under consideration, ironically at the same meeting the Mayor and Council will approve a mural that represents the “City’s commitment to celebrating community connections.” Michael Harris Properties, LLC. has filed a Project Plan Amendment to construct 83 townhome units with a small community green space at 2200 Tower Oaks Boulevard, and to request a parking waiver for the existing office building located at 2000 Tower Oaks Boulevard. It was originally approved as a hotel and a health and recreation facility at 2200 Tower Oaks Boulevard and an office building at 2000 Tower Oaks Boulevard. An isolated forest stand (forest conservation easement), roughly 10,000 sf, is proposed for removal. The replacement forest conservation will be provided through the long-term preservation of additional forested area (~7,600 sf) contiguous to the primary forest conservation easement off the back property boundary, in addition to individual trees planted on the subject property for forest conservation credit (~2,400 sf). The proposed Project Plan will require a finding of adequate public facilities for the change in use to residential townhouse development. For the office building, Michael Harris Properties is requesting a reduction of 115 vehicle parking spaces or an approximately 18% parking reduction from the required 650 vehicle parking spaces. A couple residents have already voiced concerns about several aspects of the project (a very thoughtful letter starts on page 213) and I’ll include my concerns about the continuing fragmentation of Rockville into isolated neighborhoods, in this instance physically separated from any other neighborhood. Seems like the Mayor and Council needs to examine the larger context to see that this is NOT a good location for residential use—there are no connections between this neighborhood and others in the city. How did this get through Planning Commission with hardly any discussion? Looks like they were asleep at the wheel.

The area outlined in red is 2200 Tower Oaks Boulevard, which is planned for a hotel and health and recreation facility but Michael Harris Properties is requesting a change to build 83 townhouses. Nearby uses show this would create another isolated neighborhood in Rockville, further fragmenting the community.

Mayor and Council to Receive Final Public Comments on FY24 Budget

At its Monday, April 17, 2023 meeting, the Rockville Mayor and Council will discuss FY 2024 budget (public hearing). On the Consent Calendar (items approved without discussion) are no items. The Mayor and Council will also receive reports on no items.

A March 2023 community survey revealed the top five most used services provided by the City of Rockville (even though 6% of respondents stated they lived outside of Rockville, it is a bit odd that 30% of respondents don’t use city water and sewer). Will the City Council’s proposed budget maintain and strengthen these services? Budgets reflect priorities.

This is the third and final public hearing related to the FY 2024 budget, with more than 100 suggestions received at the March 29 public hearing (lots of requests for community gardens and a new entrance to the senior center from Gude Drive, but many were boiler-plate requests which I tend to ignore). The FY 2024 operating budget totals $156.4 million for the City’s ten operating funds. This represents an overall increase of 5.1 percent from the FY 2023 adopted budget. The total number of full time equivalent (FTE) positions in the FY 2024 operating budget equals 642.7, a net increase of 4.1 FTEs from the FY 2023 adopted level. The FY 2024 proposed budget includes an additional 4.0 regular FTEs over the FY 2023 adopted budget.

The proposed Capital Improvements Program will receive $35.2 million in new funding in FY 2024. The CIP is organized by program area and provides:

  • $10 million to the Recreation and Parks program area, which includes funding for the outdoor recreation pool renovations and the design of the dance/fitness studio and multi-purpose space proposed for the King Farm farmstead;
  • $7.5 million to the Transportation program area, which includes funding for roadways, sidewalks, and ongoing LED streetlight conversions;
  • $10 million to the Utilities program area, which includes funding for water main and sewer rehabilitation;
  • $2.4 million to the Stormwater Management program area, which includes funding for stream restoration projects, storm drain analysis and spot repairs, and improvements to City stormwater facilities;
  • $5.2 million to the General Government program area, which includes funding for data center and disaster recovery infrastructure and improvements at the city’s Maintenance and Emergency Operations Facility.

Mayor and Council to Regulate Short-Term Rentals & Vape Shops

The Annual Climate Action Report notes progress in many areas, including recycling and reducing materials and waste, but ignores the second largest source of solid waste: building construction and demolition (Maryland Solid Waste Management and Diversion Report, 2021, Maryland Department of the Environment).

At its Monday, March 27, 2023 meeting, the Rockville Mayor and Council will discuss the annexation of 1201 Seven Locks Road; replace the Traffic and Transportation Commission with a Transportation and Mobility Commission; approve several regulations for residential rental facilities, room rentals, and accessory dwelling units; and consider a nine-month moratorium on businesses that primarily sell electronic cigarettes (vape stores) near schools. On the Consent Calendar (items approved without discussion) are maintenance of the water features in Town Center, Courthouse Square, and Maryvale Park; authorizing the Maryland Highway Administration to enter city property near Winding Rose Drive to make emergency repairs to an I-2710 storm drain; renewing contracts for the purchase of fuel for city vehicles, among others. The Mayor and Council will also receive reports on the climate action plan and staff hiring and vacancies (nearly 60 staff vacancies, including 7 in recreation and parks, 11 in police, and 25 in public works).

In 2015, there were approximately 6,000 rental units in Rockville and there are now approximately 10,500 units, for an increase of 4,600 rental units. On February 22, 2021, the Mayor and Council discussed short-term rentals, such as Airbnb, and determined that the rental of rooms should also be regulated through Chapter 18 like other types of residential rentals. Chapter 18 regulates landlord and tenant relations and different types of licenses and leases, however, short-term rentals operate more like a hotel than rental property. Therefore, any existing short-term rental units in the city are operating without sanction or approval, because they are out of compliance with City requirements for renting a complete living facility or home. The City Council is considering new regulations that would only allow property owners to operate short-term rentals; require an annual license; notification of adjacent property owners; city inspection for zoning, building, and fire code violations; a limited of six adults at a time; no more than 120 days of rental per year; and two off-street parking spaces among other conditions and requirements. About 25 stakeholders have participated in two public hearings and a work session, and if approved by Council, the proposed Zoning Text Amendment will be reviewed by the Planning Commission.

Pandemic Resulted in High Subsidies for Recreation and Parks in 2021

At its Monday, November 21, 2022 meeting, the Rockville Mayor and Council will discuss financial management policies, annexing 1201 Seven Locks Road, and the new Comprehensive Plan. On the Consent Calendar (items approved without discussion) are employment agreements for the Deputy City Manager and Assistant City Manager for Project Management, among others. The Mayor and Council will also receive reports on staff vacancies and hiring.

How much should the city subsidize Recreation and Parks programs, such as summer camps, skate park, or childcare, that are used by a small segment of residents? How should it manage donations it receives annually for the Holiday Drive and Senior Assistance Fund? At the upcoming meeting, the Council will discuss these and other financial management policies.

The City of Rockville has an extensive set of financial management policies that affect eight major areas: achieving and maintaining a structurally balanced budget, fund balance and reserve policies, capital planning policies, investment policies for both retirement plans and City funds, revenue control and management policies, economic development policies, and debt compliance and data analysis policies. For Recreation and Parks programs, the City uses a “five-tier cost-recovery pyramid” ranging from Tier 1 for parks, trails, landscapes, playgrounds, and general-use facilities with a 0% cost recovery to a Tier 5 for private rentals and private lessons with a 100% or more cost recovery. Fees and charges are reviewed and adjusted annually, but the pandemic lowered cost recovery significantly. In Tier 2, for example, the Lincoln Park Community Center is expected to recover 20% of its costs in 2022 (a subsidy of 80%) but in 2021 it actually recovered 3% (a subsidy of 97%). There are a couple of bright spots: Facilities Maintenance and Arts recovered more than expected (in other words, required less of a subsidy), most likely as well due to the reduced use of facilities and arts programs during the pandemic. The Financial Advisory Board recently recommended that the City create a formal donations policy. The City receives less than one percent of its revenues from donations each year, which are accepted by check, made through the City’s website, the recreation registration system, and through the round-up feature with online utility bill payments. During FY 2022, the City received approximately $130,000 in donations from over 1,800 donors, averaging $12 for the Recreation Fund and $300 for the Holiday Drive. It also received two donations over $5,000: one $25,000 donation for the Holiday Drive and one $20,000 donation for the Eat Fresh program. Strangely, when the City explored this topic further, it discovered that a donations policy is not a common practice in municipal governments in Maryland. Geez, this suggests an obvious opportunity for embezzlement in government and I’m glad to see the City is thinking ahead. It’s a common practice in nonprofit organizations.

The big kahuna for the meeting (if not the year), however, is the progress on the Rockville 2040 Comprehensive Plan—the city’s “to do” list for the next twenty years. At this meeting, the City Council will review the progress on tasks that are to be completed in the next 1-3 years. This is an enormous undertaking not only to complete, but also to manage. These tasks include a zoning ordinance rewrite, updating the Town Center Master Plan, adopting a Pedestrian Master Plan, assessing speed limits on Wootton Parkway, redeveloping King Farm Farmstead, installing back-up power generation for critical facilities, promoting backyard composting, preparing a Flood Resiliency Plan, and constructing senior housing. Since the Plan’s adoption in August 2021, 228 actions are currently in the near-term completion timeframe, but are not yet completed or in progress; 43 actions are currently in the “in progress” status; and 19 actions have been completed. If you want details on what’s happening in the City or your neighborhood, start on Packet Page 89. Getting everyone on board and focused is a continual challenge, and residents and businesses (and Council members) always have new ideas—but time and staff are limited so establishing priorities is essential.

It’s also enlightening to see which neighborhoods are most engaged in the community. In October, the City distributed surveys about community needs and interests. Among the highest response rates were College Gardens (156 responses) and Twinbrook (52 responses). Among the lowest were Tower Oaks (1 response) and Lincoln Park (0 responses). I wonder if this correlates with voter turnout?
