Mayor and Council Gets Update on Proposed 36-Unit Condo in Twinbrook
At its Monday, February 12, 2024 meeting, the Rockville Mayor and Council will receive updates on a proposed 36-unit condominium at 5906 Halpine Road (Twinbrook) and new laws under consideration by the state (particularly Gov. Moore’s proposed Housing Expansion and Affordability Act). On the Consent Agenda (items approved without discussion) are construction of a storage structure ($500,000) and executing an amendment to Rockville Intermodal Access Project for Baltimore Road, among others. The Mayor and Council will also receive an annual report from the Board of Appeals.

On the Consent Agenda, the City Council will be appointing Deputy Director of Community Planning
and Development Services Jenny Snapp as the City of Rockville Representative to the Town
Square Condominium Board, replacing Deputy Director of Public Works James Woods. The staff report provides some insight into the complex ownership and management of Town Square, explaining that it “consists of five blocks, each of which has a condominium association represented by the respective owners of each block. These owners must delegate a representative to the Rockville Town Square Master Condominium Board. The City owns portions of Block 1/2, Block 3A, Block 4 and Block 5. The City’s ownership of Block 1/2, Block 4 and Block 5 is limited to the Parking Garages. The City’s Block 3A ownership includes the Arts and Innovation Center where VisArts is located. Each block’s condominium association has an agreement delegating the management of common areas to Morguard. Several other agreements were established to delegate the management of the Plaza, the private sidewalks, and the Parking Garages to Morguard.” (page 101+)

The City Council will receive a briefing on a request from Pulte Home Company to rezone a property at 5906 Halpine Road (Twinbrook) from R-60 (single unit detached residence) to RF-FZ (residential flexible-floating zone) to permit construction of 36 two-over-two stacked condominiums (page 104+). The “two-over-two stacked” dwelling type consists of 2 two-story townhouses which are stacked one on top of the other to create a four-story building. For comparison, the adjacent Cambridge Walk has 17 townhouses. At a community meeting on May 16, 2023, attendees voiced concerns about protecting of the existing adjacent forest conservation area as well as adequate visitor parking on site. Pulte will brief the Council about the proposal, including a project overview and review schedule and at a future meeting, the Mayor and Council will hold a public hearing and consider rezoning the property, approving the Project Plan, and authorizing waivers to the required side yard setback and layback slope for the project.

Playing Musical Chairs and Three-Card Monte in Rockville City Hall
The Takoma Park City Council hired Robert DiSpirito as their new City Manager effective January 22, 2024. DiSpirito was City Manager of Rockville for seven years and by coincidence, his predecessor was Barbara Mathews, who was previously the City Manager of Takoma Park. They were also both hired and fired by the Rockville Mayor and Council, which both times included Mayor Bridget Newton and Councilmember Beryl Feinberg.
DiSpirito’s departure continues to be an embarrassment of poor management by the Mayor and Council. When he resigned at the conclusion of a Closed Session (aka “secret meeting”) of the Mayor and Council on August 17, he also received a $307,093 severance package (typically resignations don’t include severance). But figuring out what was going on was kept secret illegally for several months. According to Maryland’s Open Meetings Act, the Mayor and Council must provide minutes of a closed session at its next open session (3-306), which would have been September 11 but they failed to share the minutes. It wasn’t until October 23, 2023 (three regular meetings later) that the Mayor and Council approved the August 17 minutes (Agenda, page 218), keeping the public uninformed for more than two months. Furthermore, they played a trick in the meeting minutes. The Mayor and Council approved the official minutes of the September 11 meeting as if they included the Closed Session minutes of August 17 (watch the video of September 11 meeting and you’ll see the August 17 meeting was not discussed)–but it actually didn’t happen until October 23. Hmm, looks like the Mayor and Council is playing three-card monte with the public. Clearly, the Mayor and Council violated the Open Meetings Act but also acted unethically in the preparation of their official records.

More Pedestrians Struck in Rockville Than Reported
The recent death of a 70-year old pedestrian struck by two vehicles at Atlantic Avenue and Viers Mill Road prompted me to see if this a growing problem in Rockville. Data collected by Montgomery County suggests that many more pedestrians were injured or killed in Rockville in 2023 than the eight reported at the most recent Mayor and Council meeting. Not sure the cause of the discrepancy, but county data shows the greatest numbers of incidents occur in and near King Farm, downtown Rockville, and Twinbrook. Although these high incident areas all share major highways (MD Route 355 and 586), pedestrian injuries and deaths also occurred on smaller streets in these neighborhoods, which conflicts with the City’s conclusions. Both the City of Rockville and Montgomery County have adopted Vision Zero, but they don’t seem to be working from the same data. Should pedestrian safety be a higher priority for Rockville’s Transportation and Mobility Commission?
Database Error Leaves nearly 1,000 Rockville Voters Without Ballots
Due to reporting errors, the City of Rockville has suspended the ballot tracking system for the imminent election. Several voters lodged complaints with the Board of Supervisors of Elections in Rockville, stating they were notified via email that their votes had been cast, despite physically holding their ballots. David Sklar, a board member of BOSE, relayed an incident where a voter received an email alert that his ballot was en route for delivery, and within five minutes, another email confirmed the receipt of his voted ballot at the election office, even though the ballot was still in the voter’s possession. This incident raised concerns about potential election fraud.
At the Board of Supervisors of Elections’ (BOSE) meeting on Thursday, October 26, 2023, Chair Robert Kurnick acknowledged the severity of the issue, “Rather than trying to ascertain what should have happened, I think what we have to tell people is that the system was flawed in several respects. We’re sorry but it’s Taylor’s system….The whole point of this is to confirm voter confidence and it’s doing the opposite….It’s really bad.” Officially on the City’s website it’s described as an “unexpected issue technology affecting the ballot tracking system,” but there’s more happening behind the scenes. Turns out nearly 1,000 voters in Rockville did not receive ballots for the upcoming Mayor and Council election due to an error in the voter database.

The Taylor Corporation (no relation to City Clerk Sara Taylor-Ferrell) is a private company that manages the packaging and mailing of Rockville’s ballots but is largely invisible to voters. Although the ballot voters received in the mail has the return address of the City Clerk’s Office, it was mailed from another address and Taylor’s name does not appear on the materials. The State of Maryland uses Taylor for processing other government documents and the City of Rockville hired Taylor to package and mail the ballots this year.
The process is confusing but according to BOSE Chair Robert Kurnick, the “State of Maryland Board of Elections provides names and addresses to the Taylor Corporation, and they send out the ballot. In the last election, Maryland permitted voters to get delivery of their ballots online, so when the State of Maryland provided the name and addresses to Taylor, it would have a name and an address but for some people, it had a name and a ‘web delivery.’ So Taylor did not have addresses for those people, who in the last election, asked to have their ballots delivered online…of which there are hundreds.” The City Clerk stated it was about 800-900 ballots that were not mailed due to missing addresses in the State’s voter database. The City Clerk discovered the error when she received a copy of the database earlier this week.

The City Clerk is in the process of mailing the missing ballots and BOSE has prepared a statement for the Mayor and Council and the candidates for the upcoming election (see below), along with a message on the City’s website that noted, “This technical issue has not affected the integrity of the city’s election process. This issue affected only the ability of voters to track their ballots through the United States Postal Service. The issue had no effect on the actual delivery of ballots.” No mention of the missing ballots, alas.
The City Clerk also mentioned that a couple of thousand ballots have already been received and will be sent to the Montgomery County Board of Elections for processing. Ballots received will be posted on the City website starting on November 1; ballots are not counted until the polls close on Election Day.
Please remember to vote early by mail. Ballots must be received by (NOT mailed to) the City of Rockville by 8 pm on November 7. If you’re running late, two outdoor drop boxes are located at City Hall and Montrose Community Center. Four indoor drop boxes are located at the Senior Center, Lincoln Park Community Center, Twinbrook Community Center, and Thomas Farm Community Center only during hours of operation.
Mayor and Council to Approve 82-Townhouse Development Despite Environmental and School Capacity Concerns
At its Monday, October 2, 2023 meeting, the Rockville Mayor and Council will discuss permission to build 82 townhouses at 2200 Tower Oaks Boulevard and reduce parking by 18% at 2000 Tower Oaks Boulevard. On the Consent Calendar (items approved without discussion) are increasing funding for stormwater management from $95,000 to $422,000 and appointing David Sklar to the Board of Supervisors of Elections. The Mayor and Council will also receive reports on the Seven Locks Road Diversion Center (aka “county jail”), Financial Advisory Board, and Pedestrian Master Plan.

The Planning Commission, Bicycle Advisory Committee, and Pedestrian Advocacy Committee reviewed and approved the proposed 82-townhouse development, but strangely, the Mayor and Council excluded the Environment Commission and Education Commission. This project will replace about 10,000 sf of forest and with 7,600 sf of “new” forest; is adjacent to a stream; and subject to an existing Forest Conservation Plan (pages 47-8)—aren’t these environmental issues? For those who are concerned about school capacity in the Richard Montgomery Cluster Area, the proposed townhouse development will generate 18 students at the elementary school grade level; 10 students at the middle school level; and 14 students at the high school level (page 44). That means capacity is expected to rise to 99% for Bayard Rustin Elementary School, to 95% for Julius West Middle School, and to 123% for Richard Mongomery High School. By fall 2027, however, “capacity at Richard Montgomery is slated to be adequate due to an approved CIP project that will reassign students among Gaithersburg HS, Richard Montgomery HS, Quince Orchard HS, Thomas S. Wootton HS, and Crown HS.” What’s the purpose of the Education Committee if they aren’t aware of one of the most contentious school issues?
On pages 135-166, the Financial Advisory Board, chaired by Bob Wright, presented its FY2023 Annual report and found no discrepancies in Rockville’s financial reports; had no recommendations on the financial policies (although noted that no policies on donations was needed); found that the investment portfolio declined in value due to rising interest rates; stated that the city staff had done an outstanding job in preparing the annual budget; made three recommendations regarding the Capital Improvements Program; made complex findings and recommendations regarding the 2015 Purchasing Study; reported that the City has spent nearly $6 million on the King Farm Farmstead (and noted that the Mayor and Council do not agree on future uses); and that City is making good progress on including performance measures in the budget.
On pages 167-189, the Pedestrian Master Plan seems to be running ahead of itself and should take a step back. It offers five goals and ten recommendations, but nothing sufficiently specific nor any priorities to help the Mayor and Council know what to do next and why. Strangely, the Traffic and Transportation Department is hoping to propose an ordinance to City Council on October 23 even though the nearly 300 public comments collected since May haven’t been summarized (it doesn’t even close until October 13!). Perhaps they’re trying to get in done in “Walktober” month but it looks like they need to do a lot more research and analysis. For examples, here are pedestrian master plans from Portland and Seattle. Let’s hope the Mayor and Council provides clarity on expectations for a master plan.
October is National Arts and Humanities Month and the Rockville’s Cultural Arts Commission recommends that you celebrate by reading book, putting your child’s art on the fridge, and singing in the car, among others. Alas the expectations are pretty low, so here are five better suggestions from the non-human ChatGPT:
- Visit a Local Museum or Art Gallery: Explore the rich cultural heritage and artistic talent in your community by visiting local museums and art galleries.
- Attend a Workshop or Lecture: Many institutions offer workshops, lectures, or webinars during National Arts and Humanities Month. These can provide a deeper understanding of various art forms and humanities topics.

Rockville Town Center Dominates Community Discussions in January-March 2023

Based on an analysis of the minutes of the Rockville City Council by ChatGPT, the top five most discussed topics in the community forums from January to March 2023 seem to be:
- Town Center Parking and Plan: This topic was mentioned multiple times—what’s the future hold for downtown after the recent seismic shifts in the economy and work?
- Streetlights and Roadway Pothole Repairs: These two topics are grouped together as they both pertain to infrastructure and public works issues.
- Charter Review Commission Recommendations: The possibility of ranked-choice voting, lowering the age to vote, and establishing council districts were discussed in two different forums.
- Diversity, Equity, and Inclusion: These topics were mentioned in different contexts, reflecting the community’s interest in social issues. The Supreme Court eliminated the use of affirmative action in college admissions—how should that affect decisions by the City of Rockville?
- Rent Stabilization and Accessory Dwelling Units: Housing is an ongoing issue in Montgomery County—what is Rockville’s role and responsibility?

Clouded Judgment? Mayor and Council to Discuss Vape Shop Regulations

At its Monday, July 31, 2023 meeting, the Rockville Mayor and Council will discuss a park impact fee for new residential developments, taxes for FY2024, amending the responsibilities of the Cultural Arts Commission, and extending the moratorium on vape shops. On the Consent Calendar (items approved without discussion) are contracts for improvements to the King Farm Farmstead. This regular meeting will be preceded by a Closed Session to discuss the retention of a business (in an unusual move, the public may join the audio conference by phone).
In March 2023, the Mayor and Council adopted a nine-month moratorium on vape shops (businesses that dedicate more than 25% of its floor area to the sale, display, or use of electronic cigarettes; business with less than 25% of floor space dedicated to e-cigarettes are not affected). This moratorium expires on December 27, 2023, so the City is considering whether to adopt new regulations for vape shops or extend the moratorium. There seem to be ten vape and/or tobacco shops located in the city limits, primarily along Hungerford Drive and Rockville Pike (MD 355) along with numerous convenience stores (such as 7-Eleven), grocery stores and other retailers that sell cigarettes and electronic smoking products. Interestingly, the federal government adopted legislation in December 20, 2019 that increased the minimum age of the sale of tobacco products from 18 to 21 years old (somehow at 18 you have enough intelligence to vote, get married, or join the army but not enough smarts to buy a cigarette).
It’s unclear why the moratorium was implemented or what the Council is attempting to control, but if it’s to keep children from smoking, this may be the wrong solution. The staff report reveals that, “most underage vape/e-cigarette users do not purchase vapes from vape shops…Numerous studies show that the majority of underage users purchase or borrow vape pens from friends, purchase them online, or purchase them from convenience stores or grocery stores where age verification may be more lax.” Are e-cigarettes worse for your health than cigarettes, thus require additional regulation? Are national laws so insufficient that Rockville needs its own unique response? Somehow, this reminds me of Footloose. More details starting on page 141.

The Mayor and Council is considering revised responsibilities for the Cultural Arts Commission with troubling consequences for citizen involvement. This change is happening at the behest of the Cultural Arts Commission to promote “inclusivity and cultural richness” but they may not have noticed that the revised responsibilities also disempowers them. As proposed, the Commission will no longer review the budget for the Civic Center (where performing and visual arts are primarily presented in Rockville) nor review the design of all new City-owned cultural facilities. Instead, their primary responsibilities are to advise and make recommendations to the Mayor and Council, not encourage, assist, foster, or work. How often will the Mayor and Council ask for their advice or recommendations? The Commission is becoming more passive, less active. More details starting on page 135.

Should the Mayor and Council Give Themselves a Raise?

At its Monday, July 17, 2023 meeting, the Rockville Mayor and Council will discuss whether to ask voters to lower the voting age, allow non-citizens to vote, adopt term limits for council members, adopt ranked choice voting, and create representative districts for council members. They are also considering an annexation of 1202 Seven Locks Road (an office building south of Wootton Parkway near Seven Locks Plaza); a revision of the maximum rental rate for Moderately Priced Housing; adoption of Floating Zones; affordable housing on North Stonestreet Avenue in Lincoln Park; and a letter to the County Council regarding rent control. On the Consent Calendar (items approved without discussion) are agreements for employee retirement management, workers’ compensation, and water quality management, among others. The Mayor and Council will also receive reports on the final Rockville branding initiative and compensation for council members.
Many residents assume that the Mayor and Council are volunteers, but they are considered “part time” positions and given an “annual stipend” of $37,560 for the Mayor and $30,483 for council members. Ten years ago, it was $25,750 for the Mayor and $20,600 for council members. They are also issued a laptop computer and printer; can request office supplies, furniture, and equipment; have access to all City facilities at the same rate as City staff; and have access the City’s health, dental, vision, and life insurance at their own expense. To consider whether this should change or remain the same, the Compensation Commission conducted a city-wide survey that received 95 responses (of which 56% felt that the current compensation was reasonable; the rest were mixed) and a public forum (only two residents provided comments). They also compared stipends with other jurisdictions (Gaitherburg’s Mayor is paid $37,560 and Frederick’s is $105,937–but that’s a fulltime position), but did not consider the income of Rockville residents ($57,336 per capita; $116,031 per household; 7% live in poverty according to the US Census Bureau). The Commission is recommending that the annual stipend increase at the same COLA rate given to City staff; increase the travel allowance for council members according to the Consumer Price Index and for the Mayor by 10% to $6,600 (travel for Sister City events is provided elsewhere in the budget). Otherwise, no additional benefits (e.g., no additional funds for cell phones). The Commission also discussed the role of the annual stipend on attracting candidates for council. Mayor and Council to Consider Loosening Requirements for Accessory Apartments
At its Monday, June 5, 2023 meeting, the Rockville Mayor and Council will discuss a FY2024 Budget Debrief and an ordinance to allow accessory apartments (aka Attached Accessory Dwelling Units) in residential zones. On the Consent Calendar (items approved without discussion) are construction contracts and grant authorization. The Mayor and Council will also receive reports on Environmental Excellence Awards, Human Services Advisory Commission, and Monthly Rent Schedule for Moderately Priced Dwelling Units.
Twenty years ago, the Rockville City Council established Environmental Excellence Awards to recognize residents, organizations, and businesses for their extraordinary efforts to improve the community’s environmental and sustainability efforts. Congratulations to Rishi Iyer (a student at Wootton High School who developed an online carbon footprint tool at co2schools.com) and to Mark Wright (for leading efforts to install two pollinator gardens at Christ Church and Christ Episcopal School).
Moderately Priced Dwelling Units are the City’s methods for keeping housing affordable to families with household incomes of less than $64,000-$99,000 (depending on household size). The City regulates the maximum rent allowed and adjusts it annually according to schedules prepared by the US Department of Housing and Urban Development (HUD). For FY2024, the maximum rent is $1,330-$1,900 (depending on the number of bedrooms) for an increase of 12-13 percent compared to the current year.
Attached Accessory Dwelling Units (aka Accessory Apartments) are a second dwelling that is either attached or within the main single family detached house (not to be confused with accessory dwelling units (ADU), which are unattached or separate from the main house–I think). They are currently allowed as a Special Exception by the Board of Appeals and the City is now considering an ordinance that would allow attached accessory dwelling units as a conditional use to streamline the process and provide more housing opportunities. These types of accessory dwelling units are often used by a retired person who wants to downsize, a professional who’s moved to the area, or a college student (that’s how I lived during grad school). The City held public hearings in 2019 and 2021, the City Council discussed it in 2020, and the Planning Commission reviewed it in 2023. The Twinbrook Community Association, Lincoln Park Civic Association, East Rockville Civic Association, and West End Citizens Association support accessory apartments as a conditional use. Lots of interesting comments for and against accessory apartments, but you’ll want to read these carefully because they can refer to AirBnB, VRBO, and attached and unattached dwelling units interchangeably. When is the Next Council Meeting? Agenda Center Creates Confusion
In an effort to better align with the requirements of Maryland’s Open Meetings Act, the City of Rockville has revised the Agenda Center for Mayor and Council to included anything and everything that might be attended by one or more councilmembers. The City has violated the Open Meetings Act in previous years and new City Attorney is reviewing everything to assure compliance. The problem is that the Agenda Center is now a mishmash that makes it difficult to separate the wheat from the chaff. Can you easily locate the regular meeting of the Mayor and Council in this screenshot of the Agenda Center?

The confusion is caused by treating all meetings the same, when they’re not. Residents and businesses want to attend the meetings that have the most impact on them, which are the Mayor and Council meetings. While a councilmember may attend the East Rockville Civic Association or the Rockville Economic Development board meeting, the City Council is not making decisions about taxes or ordinances at those events. The next step is keep the audience in mind–who uses the Agenda Center? Who is it for primarily? Secondly, distinguish the meetings to highlight the meetings that are most important for the audience. Hire a good graphic designer to figure this out. Otherwise, it’s going to cause residents and business to be even more frustrated in their efforts to learn what their elected officials are doing (have you noticed that minutes aren’t available for about six weeks, which means you have to rewatch the entire council meeting for the latest news).
The latest annual report of the Maryland Open Meetings Compliance Board (which has no budget and no staff!) notes that it received 57 complaints concerning 95 separate entities, so ensuring that government operates transparently and openly is an ongoing concern. It also summarized the most common violations by city councils, boards, and commissions (emphasis mine):
“The overall number of complaints, and of those in which we found a violation, remains small in proportion to the total number of public bodies statewide. This fiscal year saw a significant increase in the number of opinions we issued (forty-eight), which is eighteen more than the previous year and the most we have issued in a single year since at least Fiscal Year 2013. But much of this increase may be attributable to COVID-19: Many complaints alleged violations of the Act based on practices that public bodies have adopted in light of the pandemic (for example, requiring the public to observe meetings virtually or limiting how many people may attend a meeting in person19), or alleged violations related to meetings (or alleged meetings) that involved topics of discussion directly related to the pandemic (for example, masking policies and other COVID-19 protocols).
“In any event, although we issued forty-eight opinions this year, we found violations in twenty-five opinions, a little over half the total number of opinions for FY 2022. Of those opinions involving one or more violations, fewer than half of the opinions (eleven)
involved a failure to provide reasonable notice of a meeting. The most common type of violation (found in eighteen opinions) involved some deficiency related to meeting minutes, either the failure to prepare or post them timely, or the failure to provide enough details. Thirteen opinions involved the failure to fully satisfy the Act’s procedural requirements for closing a meeting to the public. Eleven involved a violation of the Act’s general openness requirements, most often because a public body failed to make clear in its meeting notice that the body would be meeting in open session before entering closed session, or because a public body misapplied an exception in GP § 3-305(b) and discussed a matter in closed session that should have been open to the public.”
Mayor and Council to Regulate Short-Term Rentals & Vape Shops

At its Monday, March 27, 2023 meeting, the Rockville Mayor and Council will discuss the annexation of 1201 Seven Locks Road; replace the Traffic and Transportation Commission with a Transportation and Mobility Commission; approve several regulations for residential rental facilities, room rentals, and accessory dwelling units; and consider a nine-month moratorium on businesses that primarily sell electronic cigarettes (vape stores) near schools. On the Consent Calendar (items approved without discussion) are maintenance of the water features in Town Center, Courthouse Square, and Maryvale Park; authorizing the Maryland Highway Administration to enter city property near Winding Rose Drive to make emergency repairs to an I-2710 storm drain; renewing contracts for the purchase of fuel for city vehicles, among others. The Mayor and Council will also receive reports on the climate action plan and staff hiring and vacancies (nearly 60 staff vacancies, including 7 in recreation and parks, 11 in police, and 25 in public works).
In 2015, there were approximately 6,000 rental units in Rockville and there are now approximately 10,500 units, for an increase of 4,600 rental units. On February 22, 2021, the Mayor and Council discussed short-term rentals, such as Airbnb, and determined that the rental of rooms should also be regulated through Chapter 18 like other types of residential rentals. Chapter 18 regulates landlord and tenant relations and different types of licenses and leases, however, short-term rentals operate more like a hotel than rental property. Therefore, any existing short-term rental units in the city are operating without sanction or approval, because they are out of compliance with City requirements for renting a complete living facility or home. The City Council is considering new regulations that would only allow property owners to operate short-term rentals; require an annual license; notification of adjacent property owners; city inspection for zoning, building, and fire code violations; a limited of six adults at a time; no more than 120 days of rental per year; and two off-street parking spaces among other conditions and requirements. About 25 stakeholders have participated in two public hearings and a work session, and if approved by Council, the proposed Zoning Text Amendment will be reviewed by the Planning Commission.
